Bood was instructed by her client not to disclose the property's archaeological status. However, after the sale, the buyer was informed about the protection and the restrictions on further development. The buyer ultimately sold the property for $200,000, incurring a loss of approximately $110,000.
The regulator's decision emphasized the importance of public confidence in the real estate industry. They stated that licensees must follow and uphold the law, and the public should be aware that the superintendent will hold them accountable for any misconduct.
Bood's defense included her health problems, which led to her retirement. However, the regulator found that Bood was still obligated to disclose the property's archaeological significance.
